Seiko Epson Corporation ("Epson") has developed the simple method for measuring PFCs (Perfluorocarbon) usage. The document which details such Epson's simple method and sheets for measuring PFCs usage (collectively "Epson Method Documents") will be sent to you by e-mail, only after you agree to the terms and condition of this Agreement and you fill out the "EPSON Method Documents Application Form".

EPSON retains ownership of all intellectual property right (including patent rights, applications for patent right, copyright and know-how) relating to the simple method for measuring PFCs usage and Epson Method Documents (collectively "Epson Method"). Subject to the Agreement, you may use the Epson Method.

This Agreement is composed of "The License Terms of Epson Method" and "Privacy Policy". If you click the "I Agree" button, you are representing and warranting that you are consenting to be bound by, and you have become a party to this Agreement. If you do not agree to (or can not comply with) all of the terms of this Agreement, click the "I Do Not Agree" button, and you shall not authorized to use the Epson Method.

*If you provide PFCs measurement services to third parties and/or you design, manufacture and/or sell PFCs measurement device, tools and/or system to third parties, please contact the address above to use the Epson Method.


The License Terms of Epson Method

  1. Subject to and conditional upon the terms of this Agreement, Epson grants you non-sublicensable, non-exclusive, fully paid-up and limited license to use the Epson Method only for the purpose of measuring PFCs which are emitted from your plants ("Purpose").
  2. You may not use the Epson Method for the purpose other than the Purpose. If you desire to use the Epson Method for the purpose other than the Purpose, please contact the address above.
  3. You shall, without delay, disclose to Epson all inventions (including improvement inventions) and creations in connection with the Epson Method (collectively "Inventions"). You shall grant Epson and all Epson Method users a non-exclusive, royalty-free, fully paid-up, world wide and non-exclusive license to make, use, sell, offer, copy, modify, import and distribute, directly or indirectly, the Inventions.
  4. You shall clearly indicate that the Epson Method was used on any measurement reports submitted to industry groups.
  5. You shall not disclose or publish the Epson Method Documents to a third party without the Epson's prior written approval.
  6. You shall not copy or modify the Epson Method Documents without the Epson's prior written approval.
  7. You shall not delete, remove or modify the copyright notices in the Epson Method Documents.
  8. YOU ACKNOWLEDGE AND AGREE THAT UES OF THE EPSON METHOD IS AT YOUR SOLE RISK. THE EPSON METHOD IS PROVIDED "AS IS" AND WITHOUT ANY WARRANTY WHATSOEVER, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT OF THE RIGHTS OF A THIRD PARTY (INCLUDING WITHOUT LIMITATION RIGHTS UNDER PATENT, COPYRIGHT AND TRADE SECRETS). FURTHER, EPSON DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS (A) THE EPSON METHOD'S PERFORMANCE OR RESULTS OF MEASUREMENTS OBTAINED USING THE EPSON METHOD, OR (B) THAT ANY DOCUMENTATION (INCLUDING EPSON METHOD DOCUMENTS) ARE CORRECT, ACCURATE OR RELIABLE.
  9. IN NO EVENT SHALL EPSON BE LIABLE TO YOU OR ANY THIRD PARTY WITH RESPECT TO ANY SUBJECT MATTER OF THIS AGREEMENT WHETHER ARISING UNDER CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, BREACH OF WARRANTY, OR MISREPRESENTATION FOR: (A) ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS; OR ANY MATTER BEYOND EPSON'S REASONABLE CONTROL; OR (B) ANY DIRECT DAMAGES EXCEEDING THE AMOUNTS PAID BY YOU TO EPSON TO USE THE EPSON METHOD HEREUNDER.
  10. Epson shall not be liable for any claims, liabilities, losses, damages, costs and/or expenses (collectively, "Damages") arising out of or in connection with the Epson Method. Epson shall have no obligation to you and/or any third party to indemnify, contribute, defend or hold harmless you and/or any third party from and against any and all Damages arising out of the Epson Method. You shall defend, hold harmless and indemnify Epson from and against all Damages arising out of the Epson Method.
  11. This Agreement is effective until it is terminated. This Agreement will terminate automatically if you fail to comply with any provision of this Agreement. You may also terminate this Agreement at any time. Upon termination of this Agreement, you shall stop all use of the Epson Method. In addition, you shall return the Epson Method Documents to Epson, on Epson's instructions. Except as otherwise provided herein, the terms of this Agreement shall survive termination. Termination is not an exclusive remedy, and any and all other remedies shall be available whether or not this Agreement is terminated.

Privacy Policy

  1. Collection of Your Personal Information
    Epson collects your personal information when you enter your personal information in the "EPSON Method Documents Application Form". Personal information is information about you that is personally identifiable like your name, e-mail address and that is not otherwise publicly available.
    IMPORTANT: Please read carefully when you fill out the "ESPON Method Documents Application Form".
    • If you send personal information with a non-SSL compliant browser, the risk that information is read or intercepted by a third party interception will be increased. Please use a non-SSL compliant browser at your own risk.
    • E-mails sent to you by Epson may contain a request for return receipt. This information may be collected from you with compliant e-mail programs. If you don't wish to provide this information to Epson, please disable the return receipt function or use e-mail software that doesn't have the function.
  2. Use of Your Personal Information
    Epson collects and uses your personal information to get information how the Epson Method is being utilized (by whom and for what purpose) and to improve the Epson Method (collectively "Personal Information Usage Purpose")
    Except as described in this Agreement, your personal information will not be used for the purposes other than the Personal Information Usage Purpose.
    Epson may contact you by using your personal information to confirm how the Epson Method is being utilized.
  3. Use of Your Personal Information for Other Purposes
    Epson may use your personal for the purposes other than the Personal Information Usage Purpose if Epson believe such action is necessary to: (a) comply with the law or legal process, (b) act in urgent circumstances to protect personal safety, rights or property of person and legal person (including Epson Method users and Epson) and (c) cooperate with a national organization, local authority or person contacted perform duties required by law.
  4. Disclosure of Your Personal Information
    Except as described in this Agreement, Epson will not disclose your personal information outside of Epson and its controlled affiliates without your consent. For the purpose of clarification, when Epson makes your personal information non-identifiable, Epson may disclose such information to a third party.
  5. Changes to this Privacy Policy
    Epson may update this Privacy Policy. Epson will notify you about significant changes in the way Epson treat your personal information by sending a notice to the e-mail address specified in the "EPSON Method Documents Application Form" or by placing a prominent notice on Epson site.

    If you have questions about this Privacy Policy or believe that Epson has not adhered to it, please contact "Personal Information Management" at the address set forth below.

  7. Destruction of Your Personal Information
    Epson will treat your personal information according to this Privacy Policy. Epson will destroy or delete your personal information when Epson believes there is not need to use your personal information.
